Sex attribution and update of all documents: how we handled the identity card, driving licence, educational qualifications and contracts

Hypothetical case study developed on the basis of our experience with families dealing with international matters, intended to illustrate the type of operations the Firm is able to structure and manage for clients with a similar profile; the scenario does not refer to any specific case actually handled.

A forty-five-year-old man, an executive at a pharmaceutical company, who has completed a gender affirmation path lasting more than fifteen years. He obtained the judgment of rectification of the sex attribution from the Court, but he found himself facing a reality that few consider: the judgment is only the first step. The birth certificate must be updated. The identity card must be reissued. The tax code changes. The driving licence must be replaced. The degree and the diploma still bear the previous name. The employment contract, the mortgage, the insurance policy, the current account, the health card: every document of one’s life is linked to a civil registry identity that no longer exists. And every body, every institution, every office has its own procedures, its own timescales, its own resistances. Without coordinated management, the risk is to find oneself for months in a bureaucratic limbo in which some documents bear the new name and the new civil registry sex, others still the previous one, with practical consequences ranging from the impossibility of travelling to complications in banking and insurance relationships.

The case

A forty-five-year-old executive, head of a division at a multinational pharmaceutical company, resident in Rome. After a gender affirmation path started at thirty, which included continuous psychological support, hormonal treatment under endocrinological supervision and reassignment surgery, he obtained from the Court the judgment of rectification of the sex attribution pursuant to Law 164/1982.

 

The judgment, having become final, ordered the rectification of the birth certificate with the indication of the new sex and of the new name. But the day after the judgment, the person’s daily life had not changed: all documents still bore the previous data. And the complexity of his professional and asset situation made the documentary update particularly articulated.

 

The person turned to the Firm with a precise request: to manage in a coordinated and complete manner the update of all documents, registers and contracts connected to the civil registry identity, minimising the time and the situations in which incongruent documents could create practical problems or expose to discrimination.

 

The list of documents and relationships to be updated included:

  • Birth certificate and civil status records
  • Identity card and tax code
  • Driving licence and vehicle registration document
  • Health card and electronic health record
  • School-leaving diploma and master’s degree
  • Executive employment contract and INPS pension position
  • Mortgage loan and bank current account
  • Insurance policies (life, motor liability, supplementary health)
  • Registration with the professional register
  • Passport

The challenge

The documentary update phase following the judgment is, from an operational point of view, one of the parts of the rectification path that can present the greatest practical complexities, sometimes even more than the judicial phase. Each document and each register falls under a competent body, a specific procedure and its own timescales, and the absence of fully centralised coordination often makes case-by-case management necessary.

The fragmentation of procedures

  • There is no single update procedure that automatically propagates from the rectification of the birth certificate to all the other documents: in most cases, the updates must be requested individually from the competent body, according to the documentation and the arrangements provided by each
  • Some updates follow from the annotation of the judgment in the civil status registers, while others require a specific application by the interested party or further formalities before the administration or the competent subject
  • The update timescales are not necessarily synchronised: the identity card can be available within relatively short times, the update of other positions may require some weeks or months. In the meantime, the person may find themselves handling documents or administrative positions that are not yet uniform

The educational qualifications

  • The rectification of the educational qualifications (diploma and degree) normally requires an application to the school or university that issued the qualification, accompanied by the documentation attesting to the rectification. The procedure is not governed uniformly and the practices can vary between universities
  • Some universities provide for the issue of new documentation with the updated data, others proceed by means of internal annotations or with different administrative arrangements, with timescales that can vary considerably
  • The school-leaving diploma may follow a distinct path, involving the school that issued the qualification and, depending on the case, the competent school offices, sometimes with difficulties related to retrieving the original documentation

Contractual and financial relationships

  • The employment relationship must be updated with the new civil registry data: the procedure varies according to the type of relationship and the organisational structure of the employer. In complex corporate contexts, the update may involve several internal functions, including human resources, personnel administration and information systems
  • Where there is a mortgage or other banking relationships, it is generally advisable to make a formal communication to the credit institution, attaching the documentation attesting to the rectification, so that the bank can update the data relating to the existing relationship according to its own procedures
  • Insurance policies, in particular long-term ones, also require careful updating of the civil registry and identifying data, in order to avoid documentary discrepancies or issues in the management of the relationship
  • The pension position and the related contribution records must also be verified and, if necessary, updated, to ensure administrative continuity and consistency of the data

The dimension of confidentiality

  • Each update request may entail the need to communicate to a body or a private subject the civil registry rectification that has taken place: information that the person may wish to share only to the extent strictly necessary
  • The management of the communication to the employer is a particularly delicate aspect, especially in contexts where the person has already completed the social transition and does not wish the information to spread beyond the strictly necessary functions, also in light of the aspects of confidentiality and anti-discrimination protection

The solution

The Firm would structure the intervention as a coordinated project, with a logical sequence of updates organised by priority and dependencies, preventing the person from having to independently manage a plurality of interlocutors with different procedures.

1. Update of the primary documents (immediate priority)

  • Transmission of the judgment to the Civil Status Officer of the municipality of birth for its annotation in the registers: this is the step on which, in most cases, the subsequent updates depend
  • Request for the new birth certificate (or updated extract) with the rectified data: the reference document for the subsequent formalities
  • Communication to the Revenue Agency for the purpose of assigning the new tax code: the tax code also incorporates elements linked to the civil registry sex and, following the rectification, is updated according to the Administration’s procedures. This step is normally preparatory to the update of the health card
  • Request for the issue of the new identity card at the municipality of residence, with the updated civil registry data
  • Request for the update of the health card, according to the timescales and arrangements linked to the assignment of the new tax code

2. Certification documents and professional registers

  • Application to the Motor Vehicle Registry for the update of the data on the driving licence and, where necessary, of the data relating to the vehicles registered to the person
  • Request for the issue of the new passport at the competent Police Headquarters; communication to any professional register of membership for the update of the registration with the new civil registry data

3. Rectification of the educational qualifications

  • Application to the university for the update of the data relating to the qualification: preparation of the formal request with attachment of the documentation attesting to the rectification, dialogue with the student registry to verify the specific procedure of the university and the expected timescales
  • Application to the school and the competent school offices for the update of the school-leaving diploma: verification of the availability of the documentation and preparation of the required formalities
  • Monitoring of the progress of both procedures, which may require longer timescales than the identity documents

4. Update of the contractual and financial relationships

  • Preparation of the communication to the employer for the update of the civil registry data and of the administrative position: the Firm could prepare a note suitable to allow the update in compliance with confidentiality, limiting the circulation of the information to the corporate functions involved alone
  • Communication to the credit institutions for the update of the existing banking relationships (current account, financing, mortgage): preparation of the necessary documentation and, where required, assistance in formalising any steps required by the bank
  • Communication to the insurance companies for the update of the policies: verification of the operational arrangements and of any effects on the contractual parameters; communication to the pension bodies for the verification and possible update of the contribution position
  • Verification of the need to update the data in the property and cadastral registers, according to the arrangements provided by the competent offices

5. Coordination and monitoring

  • Preparation of a timetable with the logical sequence of the updates, the main dependencies between one step and another, the indicative timescales and the intermediate deadlines
  • Periodic monitoring of the progress of the files, with any reminders to the competent bodies and management of the issues that may emerge during the process
  • Support in preparing documentation useful in the transitional period to demonstrate the rectification that has taken place and the state of update of the documents, within the limits of the applicable administrative practices

The result

The intervention could develop, indicatively, over six to ten months from taking on the case, with timescales varying according to the responsiveness of the individual bodies and the complexity of the specific procedures.

  • The primary documents (identity card, tax code, health card) can be updated, in practice, within the first four to six weeks of taking on the case, allowing the most frequent situations of documentary incongruence in daily life to be reduced
  • Driving licence, passport and any registration with the professional register can be updated in the first months, depending on the timescales of the competent administrations
  • Employment contract, pension position, banking and insurance relationships can be updated progressively, also through formal communications managed by the Firm in compliance with the person’s confidentiality
  • Educational qualifications (degree and diploma) may require more extended timescales, even of several months, depending on the procedures adopted by the universities and the competent school offices
  • Any updates relating to cadastral data or registrations in the property registers are assessed and managed, where necessary, in coordination with the other formalities

At the end of the path, the person’s personal documentation can prove progressively aligned and consistent with the rectified data. No longer a situation in which different documents bear discrepant information, but a coherent and updated set of documents. This is the concrete result that transforms a rectification judgment from a judicial act into a reality lived in every aspect of daily life.
