The rule of the <strong>Codice civile<\/strong> regulates this hypothesis, providing that if the called party has not accepted the inheritance and is not in possession of the inheritance assets, the Tribunale of the place where the succession was opened, on request of the interested parties or ex officio, can appoint a curator to manage the inheritance.<\/p>\n<\/p>\n<p>From the <strong>Codice civile<\/strong> three unfavourable consequences emerge for the called party in case of lying inheritance.<\/p>\n<\/p>\n<p>These effects are the following:<\/p>\n<ul>\n<li>According to the last paragraph of the rule, the called party cannot carry out actions of possession, nor perform acts of conservation, supervision or temporary management once the curator of the inheritance has been appointed. The logic behind this provision is that, given that the appointment of the curator occurred due to the previous inactivity of the called party, allowing them to intervene at this point would be useless and could hinder the work of the curator.<\/li>\n<li>The impossibility of registering judicial mortgages on inheritance assets, as provided for by law. This rule aims to ensure equitable treatment between the creditors of the deceased, given that, since heirs are not yet present, there are no creditors linked to the heirs themselves, but only those of the deceased.<\/li>\n<li>In case of liquidation of the inheritance, the creditors cannot start enforcement procedures on the inheritance assets.<\/li>\n<\/ul>\n<\/div>\n<div>\n<h2>The prerequisites of lying inheritance<\/h2>\n<\/div>\n<div>\n<p>According to the regulation cited above, three conditions for the existence of lying inheritance can be identified:<\/p>\n<ol>\n<li>The inheritance must not have been accepted yet;<\/li>\n<li>The called party must not be in possession of the inheritance assets;<\/li>\n<li>A curator of the inheritance must have been appointed.<\/li>\n<\/ol>\n<p>The possibility of accepting the inheritance represents an essential requirement for the existence of lying inheritance. In fact, the called party must still exercise their right of acceptance, which remains valid until the curator has completed their assignment.<\/p>\n<\/p>\n<p>At the moment of acceptance of the lying inheritance by the last called party, the task of the curator ends, since it is no longer necessary. It will be the new owner who will deal with the conservation and management of the inheritance.<\/p>\n<\/p>\n<p>As a second condition, the called party must not have possession of the inheritance assets. Even simple detention can exclude the presence of a lying inheritance. There must be a concrete and physical relationship between the called party and the assets for possession to be configured, which would exclude the lying inheritance.<\/p>\n<\/p>\n<p>The appointment of the curator for the lying inheritance has the effect of making the inheritance truly lying. Only with this act, in fact, does the inheritance assume such status, since the called party is deprived of the power to administer it.<\/p>\n<\/p>\n<p>This figure plays a central role in the regulation of lying inheritance. Their designation takes place by decision of the court competent for the territory in which the succession was opened, ex officio or on request of the parties involved. The person called to the inheritance cannot be appointed curator, since their inactivity has made the appointment of the curator necessary.<\/p>\n<\/p>\n<p>The appointment is formalised by a decree of the Tribunale, which the clerk publishes by extract in the bulletin of legal announcements of the province and registers in the register of successions.<\/p>\n<\/p>\n<p>The curator, after having taken the oath, performs the following activities:<\/p>\n<ul>\n<li>carry out preliminary operations, such as the drafting of the inventory, following the modalities provided for by the <strong>Codice civile<\/strong> for acceptance with benefit of inventory and the rules of the Codice di procedura civile, and perform urgent acts;<\/li>\n<li>protect the interests of the inheritance and respond to requests advanced against it. The curator therefore has active and passive legitimation in the proceedings linked to the exercise of their functions;<\/li>\n<li>administer the inheritance assets under the supervision and prior authorisation of the court, performing acts of ordinary and extraordinary administration;<\/li>\n<li>deposit at postal funds or credit institutions designated by the court the money belonging to the inheritance or deriving from the sale of movable or immovable assets;<\/li>\n<li>render an account of their management;<\/li>\n<li>pay the inheritance debts with the authorisation of the court, except for opposition by creditors or legatees, in which case they will have to liquidate the inheritance;<\/li>\n<li>submit the declaration of succession for the payment of the taxes due.<\/li>\n<\/ul>\n<p>The following categories of subjects can request the appointment of a curator:<\/p>\n<ul>\n<li>those called to the inheritance not in possession of the assets;<\/li>\n<li><span> <\/span><span>those called subordinately;<\/span><\/li>\n<li><span> <\/span><span>the legatees;<\/span><\/li>\n<li>the creditors of the inheritance;<\/li>\n<li>the creditors of the called party to the inheritance;<\/li>\n<li>those called who possess only a share of the inheritance assets and the co-heirs, if lying status is recognised pro quota.<\/li>\n<\/ul>\n<p>Each of these subjects can submit a request for the appointment of the curator, since the law does not provide for limits of legitimation in this regard.<\/p>\n<\/p>\n<p>Among their tasks, the curator also has the power to dispose of the sale of the movable and immovable inheritance assets of the inheritance patrimony, while dispositive acts such as acceptance or <a href=\"https:\/\/www.familylawboschetti.com\/en\/inheritance\/renunciation-of-the-inheritance\/\">renunciation of the inheritance<\/a> are not allowed to the curator.<\/p>\n<\/p>\n<p>The curator ceases their functions at the moment in which the inheritance is accepted. Once the last called party accepts, there is no longer need for the curatorship, which therefore is extinguished. <span>Other causes of cessation are:<\/span><\/p>\n<ul>\n<li>the exhaustion of the inheritance assets, when there are no more assets to administer;<\/li>\n<li>the devolution of the inheritance to the State, if all the called parties renounce.<\/li>\n<\/ul>\n<p>The cessation of the curatorship does not require a judicial measure. If the curator was not aware of the acceptance of the inheritance, they could continue to exercise their office, but the acts performed by them would remain valid and binding for the heirs.<\/p>\n<\/p>\n<p>Lying status does not extinguish in cases in which the curator abandons their office and the Tribunale must provide for the appointment of a new curator, as in the following scenarios:<\/p>\n<ul>\n<li><span> <\/span><span>death of the curator;<\/span><\/li>\n<li>revocation of the assignment by the court;<\/li>\n<li><span> <\/span><span>renunciation of the assignment;<\/span><\/li>\n<li>incapacity to perform their functions.<\/li>\n<\/ul>\n<\/div>\n<div>\n<h2>Lying inheritance for foreigners: is the assistance of a defender necessary?<\/h2>\n<\/div>\n<div>\n<p>When speaking of lying inheritance and foreign heir or person residing abroad, there are various relevant aspects to consider.<\/p>\n<\/p>\n<p>In case of lying inheritance, the Italian Tribunale appoints a curator to administer the patrimony until the heir is identified or formally accepts the inheritance. This can also concern a foreign heir, who will have to follow the Italian procedures to accept the inheritance, including respect for the formalities provided for by Italian law, which can provide for express or tacit acceptance.<\/p>\n<\/p>\n<p><strong>EU Regulation n. 650\/2012<\/strong> establishes that the law applicable to the succession is, as a rule, that of the State in which the deceased had habitual residence, but the deceased can choose that the law of their Country of citizenship be applied, which can have an impact on the rights of the foreign heir.<\/p>\n<\/p>\n<p>If the deceased possessed assets in Italy, the competent court is that of the place where such assets are located, and the foreign heir must turn to this court to assert their rights.<\/p>\n<\/p>\n<p>Furthermore, the foreign heir must be recognised as such according to the law applicable to the succession, which might require additional procedures or documentation compared to the regulation of their Country of origin.<\/p>\n<\/p>\n<p>International treaties can influence inheritance rights and the procedures in force, simplifying or complicating the acceptance of the inheritance.<\/p>\n<\/p>\n<p>The foreign heir will also be subject to Italian taxation for the assets inherited in Italy, regardless of their residence.<\/p>\n<p>Finally, practical difficulties may arise for the foreign heir, such as the language barrier or geographical distance, which may therefore make the assistance of an Italian lawyer necessary to correctly manage the situation.<\/p>\n<\/div>\n<div>\n<h2>Lying inheritance and vacant inheritance: the differences<\/h2>\n<\/div>\n<div>\n<p>The lying inheritance, however, could be confused with another institution, that of vacant inheritance.<\/p>\n<\/p>\n<p>The inheritance is defined as &#8220;lying&#8221; at the moment in which the subject called to succeed, that is to say the person designated by the will or by law, has not yet formally accepted the inheritance, but retains the right to do so within a certain term. This situation is created to avoid that the inheritance assets remain without management or legal protection. For this reason, the competent Tribunale (Civil Court) can appoint a curator of the lying inheritance, a figure entrusted with temporarily administering the patrimony until the heir decides whether to accept or renounce the inheritance.<\/p>\n<\/p>\n<p>The curatorship has the task of preserving the inheritance assets, avoiding their dissipation and satisfying the most urgent needs linked to the inheritance itself, such as the payment of debts.<\/p>\n<\/p>\n<p>According to the Italian <strong>Codice civile<\/strong>, the curator of the sole lying inheritance has specific obligations, such as the inventory of the lying inheritance and its administration with the diligence of the good family father, thus ensuring the protection of the inheritance patrimony.<\/p>\n<\/p>\n<p>Differently, the inheritance becomes &#8220;vacant&#8221; when no one has accepted the inheritance or there are no heirs, whether testamentary or legitimate. This condition can occur even if the potential heirs have renounced the inheritance, or if their right has lapsed or is prescribed, that is to say they have not exercised the right of acceptance within the terms provided for by law.<\/p>\n<\/p>\n<p>In such a case, the State intervenes as necessary heir. According to the Italian system, the assets of vacant inheritance pass to the State, which succeeds the deceased and becomes the holder of the inheritance patrimony. The State takes over with the same obligations that would have weighed on the heirs, in particular those relating to the payment of debts and to the fulfilment of legacies, but the State is liable for such obligations only within the limits of the value of the inherited assets.<\/p>\n<\/p>\n<p>The intervention of the State as heir is aimed not only at the protection of public interests, but also at ensuring the rights of any creditors and legatees. The rule of the <strong>Codice civile<\/strong> regulates this hypothesis, providing that if the called party has not accepted the inheritance and is not in possession of the inheritance assets, the Tribunale of the place where the succession was opened, on request of the interested parties or ex officio, can appoint a curator to manage the inheritance.<\/p>\n\n\\n\n\n\n\n\\n\n\n<p>From the <strong>Codice civile<\/strong> three unfavourable consequences emerge for the called party in case of lying inheritance.<\/p>\n\n\\n\n\n\n\n\\n\n\n<p>These effects are the following:<\/p>\n\n\\n\n\n<ul>\\n\n\n<li>According to the last paragraph of the rule, the called party cannot carry out actions of possession, nor perform acts of conservation, supervision or temporary management once the curator of the inheritance has been appointed. The logic behind this provision is that, given that the appointment of the curator occurred due to the previous inactivity of the called party, allowing them to intervene at this point would be useless and could hinder the work of the curator.<\/li>\n\n\\n\n\n<li>The impossibility of registering judicial mortgages on inheritance assets, as provided for by law. In fact, the called party must still exercise their right of acceptance, which remains valid until the curator has completed their assignment.<\/p>\n\n\\n\n\n\n\n\\n\n\n<p>At the moment of acceptance of the lying inheritance by the last called party, the task of the curator ends, since it is no longer necessary. It will be the new owner who will deal with the conservation and management of the inheritance.<\/p>\n\n\\n\n\n\n\n\\n\n\n<p>As a second condition, the called party must not have possession of the inheritance assets. Even simple detention can exclude the presence of a lying inheritance. There must be a concrete and physical relationship between the called party and the assets for possession to be configured, which would exclude the lying inheritance.<\/p>\n\n\\n\n\n\n\n\\n\n\n<p>The appointment of the curator for the lying inheritance has the effect of making the inheritance truly lying. Only with this act, in fact, does the inheritance assume such status, since the called party is deprived of the power to administer it.<\/p>\n\n\\n\n\n\n\n\\n\n\n<p>This figure plays a central role in the regulation of lying inheritance. Their designation takes place by decision of the court competent for the territory in which the succession was opened, ex officio or on request of the parties involved. The person called to the inheritance cannot be appointed curator, since their inactivity has made the appointment of the curator necessary.<\/p>\n\n\\n\n\n\n\n\\n\n\n<p>The appointment is formalised by a decree of the Tribunale, which the clerk publishes by extract in the bulletin of legal announcements of the province and registers in the register of successions.<\/p>\n\n\\n\n\n\n\n\\n\n\n<p>The curator, after having taken the oath, performs the following activities:<\/p>\n\n\\n\n\n<ul>\\n\n\n<li>carry out preliminary operations, such as the drafting of the inventory, following the modalities provided for by the <strong>Codice civile<\/strong> for acceptance with benefit of inventory and the rules of the Codice di procedura civile, and perform urgent acts;<\/li>\n\n\\n\n\n<li>protect the interests of the inheritance and respond to requests advanced against it. The curator therefore has active and passive legitimation in the proceedings linked to the exercise of their functions;<\/li>\n\n\\n\n\n<li>administer the inheritance assets under the supervision and prior authorisation of the court, performing acts of ordinary and extraordinary administration;<\/li>\n\n\\n\n\n<li>deposit at postal funds or credit institutions designated by the court the money belonging to the inheritance or deriving from the sale of movable or immovable assets;<\/li>\n\n\\n\n\n<li>render an account of their management;<\/li>\n\n\\n\n\n<li>pay the inheritance debts with the authorisation of the court, except for opposition by creditors or legatees, in which case they will have to liquidate the inheritance;<\/li>\n\n\\n\n\n<li>submit the declaration of succession for the payment of the taxes due.<\/li>\n\n\\n<\/ul>\n\n\\n\n\n\n\n\\n\n\n<p>The following categories of subjects can request the appointment of a curator:<\/p>\n\n\\n\n\n<ul>\\n\n\n<li>those called to the inheritance not in possession of the assets;<\/li>\n\n\\n\n\n<li><span> <\/span><span>those called subordinately;<\/span><\/li>\n\n\\n\n\n<li><span> <\/span><span>the legatees;<\/span><\/li>\n\n\\n\n\n<li>the creditors of the inheritance;<\/li>\n\n\\n\n\n<li>the creditors of the called party to the inheritance;<\/li>\n\n\\n\n\n<li>those called who possess only a share of the inheritance assets and the co-heirs, if lying status is recognised pro quota.<\/li>\n\n\\n<\/ul>\n\n\\n\n\n\n\n\\n\n\n<p>Each of these subjects can submit a request for the appointment of the curator, since the law does not provide for limits of legitimation in this regard.<\/p>\n\n\\n\n\n\n\n\\n\n\n<p>Among their tasks, the curator also has the power to dispose of the sale of the movable and immovable inheritance assets of the inheritance patrimony, while dispositive acts such as acceptance or <a href=\\\"\/en\/inheritance\/renunciation-of-the-inheritance\/\\\">renunciation of the inheritance<\/a> are not allowed to the curator.<\/p>\n\n\\n\n\n\n\n\\n\n\n<p>The curator ceases their functions at the moment in which the inheritance is accepted. Once the last called party accepts, there is no longer need for the curatorship, which therefore is extinguished. <span>Other causes of cessation are:<\/span><\/p>\n\n\\n\n\n<ul>\\n\n\n<li>the exhaustion of the inheritance assets, when there are no more assets to administer;<\/li>\n\n\\n\n\n<li>the devolution of the inheritance to the State, if all the called parties renounce.<\/li>\n\n\\n<\/ul>\n\n\\n\n\n\n\n\\n\n\n<p>The cessation of the curatorship does not require a judicial measure. For this reason, the competent Tribunale (Civil Court) can appoint a curator of the lying inheritance, a figure entrusted with temporarily administering the patrimony until the heir decides whether to accept or renounce the inheritance.<\/p>\n\n\\n\n\n\n\n\\n\n\n<p>The curatorship has the task of preserving the inheritance assets, avoiding their dissipation and satisfying the most urgent needs linked to the inheritance itself, such as the payment of debts.<\/p>\n\n\\n\n\n\n\n\\n\n\n<p>According to the Italian <strong>Codice civile<\/strong>, the curator of the sole lying inheritance has specific obligations, such as the inventory of the lying inheritance and its administration with the diligence of the good family father, thus ensuring the protection of the inheritance patrimony.<\/p>\n\n\\n\n\n\n\n\\n\n\n<p>Differently, the inheritance becomes \\\"vacant\\\" when no one has accepted the inheritance or there are no heirs, whether testamentary or legitimate. This condition can occur even if the potential heirs have renounced the inheritance, or if their right has lapsed or is prescribed, that is to say they have not exercised the right of acceptance within the terms provided for by law.<\/p>\n\n\\n\n\n\n\n\\n\n\n<p>In such a case, the State intervenes as necessary heir. According to the Italian system, the assets of vacant inheritance pass to the State, which succeeds the deceased and becomes the holder of the inheritance patrimony. The State takes over with the same obligations that would have weighed on the heirs, in particular those relating to the payment of debts and to the fulfilment of legacies, but the State is liable for such obligations only within the limits of the value of the inherited assets.<\/p>\n\n\\n\n\n\n\n\\n\n\n<p>The intervention of the State as heir is aimed not only at the protection of public interests, but also at ensuring the rights of any creditors and legatees. The State, in fact, cannot withdraw from the payment of inheritance debts or of the legacies disposed by the deceased, but is limited in its liability to the value of the patrimony received.
