This procedure ensures the recognition of acquired rights and allows the regularisation of civil status. A correct procedure prevents future administrative problems and uncertainties about the status of the persons involved.

The recognition and registration of a foreign divorce in Italy represent a crucial step to ensure the full legal validity of the measure in our legal system. This process allows Italian citizens and foreigners residing in Italy to adapt their civil status, ensuring that a divorce judgment obtained abroad produces legal effects on Italian territory, with significant consequences for the personal and legal life of those concerned. Without registration, in fact, the foreign divorce is not legally effective in Italy, leaving those concerned in a position of legal uncertainty.

Italian and international legislation provides the reference framework to ensure that registration complies with legal requirements, providing for specific mechanisms for automatic recognition or through more complex procedures in the event of disputes.

Thanks to the guidance of legal experts, such as Boschetti Studio Legale, an established reality in the field of international law, the registration of a foreign divorce measure in Italy becomes a simplified practice, to be handled without stress and in rapid times.

What the registration of a foreign divorce is and why it is important

The registration of a foreign divorce is a fundamental step both for the Italian citizen and for the foreigner residing in Italy, being a fulfilment that must be carried out if one wants the foreign divorce to have legal effects on Italian territory.

In essence, the registration of a foreign divorce is the formal process that allows a foreign divorce judgment, or other equivalent act, to be recognised and, consequently, to be registered in the Italian civil status registers. Without registration, the divorce has no legal effects in Italy, leaving the person concerned formally still married in official documents. Therefore, the registration in question is indispensable to modify the civil status of the person, ensuring the possibility of contracting a new marriage or of regulating property and inheritance issues.

Registration is also necessary for the updating of personal documents, such as passport and identity card. The absence of registration can generate legal conflicts, especially in inheritance matters, creating confusion in property and family relationships. As regards specifically foreigners, Italian legislation provides that, upon request of foreign citizens residing in Italy, the civil status acts concerning them formed abroad may be registered in the municipality in which they reside, including, evidently, also the foreign divorce.

Relying on Boschetti Studio Legale, with its consolidated experience in international and immigration law, is fundamental for those who wish to have a foreign divorce registered in Italy. Our task is also to inform the client that the recognition of foreign divorce judgments and acts is regulated by articles 64 et seq. of legge n. 218/1995 and by the EU Regulation Brussels II bis, as well as by certain international conventions to which Italy is a party, such as the Hague Convention of 1 June 1970, which applies to the recognition of divorces and separations obtained in another contracting State, effective between Italy, Australia, Egypt, Switzerland, Denmark and Norway.

This wealth of legal knowledge allows the firm to offer qualified support so that the procedure is carried out in compliance with Italian and international regulations, avoiding legal and bureaucratic complications, as well as avoidable losses of time and money. Thanks to in-depth knowledge of issues relating to the recognition of foreign judgments, we ensure our clients an effective management of the process, while at the same time protecting their rights and the history of their civil status, so that it is consistent with that of the State in which the divorce was pronounced.

Validity of a foreign divorce in Italy and registration

When one is faced with a separation or divorce judgment issued abroad, the question of their recognition in Italy must absolutely be addressed, with the awareness that the related path can hide pitfalls. Boschetti Studio Legale, with its experience in international law, accompanies you step by step to ensure that the procedure for registering a foreign divorce is carried out in compliance with the regulations of private international law.

It must immediately be premised that, in the past, for the recognition of foreign judgments a formal proceeding before the Court of Appeal was necessary, which verified its compatibility with the Italian legal system. Only after this procedure could the judgment be registered in the civil status registers.

With the introduction of legge n. 218 of 31 May 1995, “Reform of the Italian system of private international law”, this process has been simplified because the recognition of foreign judgments and acts has become automatic (subject to the exceptions we are going to see).

Article 64, “Recognition of foreign judgments”, in fact, provides that the foreign judgment is recognised in Italy, without the need to open any proceeding, when:

a) the judge who pronounced it could hear the case according to the principles on jurisdiction proper to the Italian legal system;

b) the introductory act of the proceeding was brought to the knowledge of the defendant in conformity with what is provided for by the law of the place where the proceeding took place and the essential rights of the defence were not violated;

c) the parties appeared in court according to the law of the place where the proceeding took place or contumacy was declared in conformity with such law;

d) it has become res judicata according to the law of the place in which it was pronounced;

e) it is not contrary to another judgment pronounced by an Italian judge that has become res judicata;

f) no proceeding is pending before an Italian judge for the same subject matter and between the same parties, which started before the foreign proceeding;

g) its provisions do not produce effects contrary to public policy.

Of considerable importance is also article 67, which refers to situations in which the possession, by a foreign judgment, of the requirements listed above is contested. It also concerns cases in which a judgment, although in itself capable of producing effects in the internal legal system, is not concretely executed or requires forced execution.

In fact, the legislator has established the general principle of the automatic production of the effects of a foreign ruling in the national legal system. However, the possibility of disputes has also been considered. In such situations, art. 67, paragraph 1, provides that anyone who has an interest may turn to the competent Court of Appeal in the place where implementation is requested, in order to ascertain the presence of the requirements necessary for recognition.

The rule also distinguishes the effects of the declaratory ruling depending on whether or not the contestation takes place in the context of a proceeding. In the case in which this takes place during a proceeding, paragraph 3 of art. 67 establishes that the judge seised may verify the existence of the requirements required by law, but with effects limited exclusively to the proceeding in which the verification was carried out.

To date, therefore, at the administrative level, foreign judgments can be recognised through a control carried out by the civil status officer, without the need for a formal judgment. The legislation requires that the judgment be presented in authenticated copy, accompanied by an official translation and, where required, legalised or apostilled. The officer verifies the conformity of the judgment with the principles of the Italian legal system, including the absence of conflicts with previous Italian judgments and compatibility with public policy.

Obviously it is indispensable that the foreign judgment clearly attests to the irreversible breakdown of the marital bond, a cardinal principle of Italian law for the dissolution of marriage. Even judgments based on prerequisites different from Italian regulations may be recognised, provided they respect the fundamental rights of the parties.

Furthermore, since divorce judgments are automatically recognised and entail, as has been said, the dissolution of the bond, it will be useful to request an Italian divorce based on a previous foreign divorce precisely when the foreign divorce is not directly recognisable, for example for contrariety to public policy.

It is important to underline that not only foreign divorce judgments can be registered in Italy; also divorces pronounced with public deeds, specifically with notarial deeds, can be recognised and registered in Italy, as the regulation of art. 64 l. 218/1995 also includes administrative decisions or in any case those of a public authority, not identifiable with a judicial one in matters that in Italy are dealt with by the Judge or decided by judgment, subject to compliance with the requirements already seen. In Brazil, for example, divorce, if it is consensual and there are no particular issues to be defined (e.g. on child custody), can be carried out by a notary (in the “Cartórios”) without having to resort to the Court.

Relying on Boschetti Studio Legale, a Law Firm specialising in international law, is a strategic choice for those who must obtain the recognition of a foreign divorce judgment or of a foreign public deed of divorce in Italy. Thanks to the firm’s competence in handling complex cases involving regulations of different legal systems, clients receive complete support to ensure that the legal requirements are met and that the rights of the parties are fully protected, without incurring unnecessary losses of time and money.

Where to register the foreign divorce

The registration of a foreign divorce in Italy must be requested directly at the Italian Municipality by the person concerned, or through the Italian Consulate in the constituency in which the judgment was pronounced.

To start the registration request it is necessary to provide a valid identity document and to present the following documents:

Application for transmission of the judgment, drafted as a substitutive declaration of notorious deed pursuant to art. 47 of DPR 445/2000. In this declaration, the person concerned must attest that the judgment respects the requirements of art. 64 of legge 218/1995, specifying that it is not in conflict with judgments issued by an Italian judge and that there are no proceedings pending before Italian judges concerning the same subject matter and the same parties.

Full copy of the judgment, complete with the requirements provided for by art. 64, legalised and officially translated into Italian.

It must be said that often, when the registration request is presented through the Consulate by the person concerned, the procedure gets stuck precisely in the passage of the act from the consular authority to the reference Municipality, due to fragmentary communication between public administrations, the intervention of Boschetti Studio Legale can prove decisive: even if resident abroad, the person concerned can confer on the firm the assignment to request directly in Italy the registration of the foreign divorce. Boschetti Studio Legale will take care of representing the client before the competent Municipality and of facilitating the dialogue between the latter and the Italian Consulate, ensuring a faster and more effective management of the procedure.

Before initiating any legal support initiative, the firm takes care to contact the diplomatic or consular representation territorially competent, based on the place of residence of the client, in order to obtain additional clarifications or information on any specific requirements established by bilateral or multilateral Agreements applicable, that may avoid negative surprises during the journey.

Procedure for registration: the steps to follow to register a foreign divorce

The registration of the foreign divorce judgment is a mandatory step to ensure the legal recognition of the divorce in Italy. According to legge 218/1995 on private international law, foreign judgments can be recognised automatically, provided they meet the compatibility requirements with the Italian legal system. Only in the event of a dispute, due to the absence of one of the requirements of art. 64 of the aforementioned law, may it be necessary to commence proceedings before the competent Court of Appeal in order to obtain the recognition of the foreign divorce.

However, registration at the Italian Municipality is always necessary to formalise the recognition.

The process for registering a foreign divorce involves several phases, and Boschetti Studio Legale can manage them for its clients with absolute dedication and competence.

First of all, it is necessary to obtain the original divorce judgment from the competent foreign authority and to translate it officially into Italian. In countries adhering to the Hague Convention, the Apostille is required, while for those not adhering the judgment must be legalised at the Italian Consulate. For example, an Italian citizen divorced in the United States will have to follow this procedure before submitting the documents in Italy.

Once the documentation is complete, it can be deposited at the Italian Municipality or at the competent Consulate, depending on the residence of the applicant. The civil status officer verifies the conformity of the judgment with Italian rules and, if positive, proceeds with its registration in the civil status registers. For divorces that took place in an EU country, as we will see shortly, Regulation (CE) 2201/2003 further simplifies the process, eliminating the obligation of translation or legalisation.

Thanks to our specialisation in international law, Boschetti Studio Legale will help you to avoid errors and to overcome any complexities. We offer complete support, from the verification of the documentation to the interaction with the competent authorities, ensuring that your foreign divorce is officially recognised in Italy.

Registration of EU foreign divorce: simplified procedures

Boschetti Studio Legale, specialised in international law, assists its clients in the recognition and registration of divorce judgments issued in a State of the European Union, ensuring complete and personalised support.

For divorce judgments issued in a State of the European Union, the recognition and the registration of the EU foreign divorce are regulated by Regulation (CE) n. 2201/2003, which entered into force on 1 March 2005.

This Regulation, which replaced the previous Regulation (CE) n. 1347/2000, establishes uniform rules for jurisdiction, recognition and enforcement of decisions in matrimonial matters and matters of parental responsibility.

The Regulation applies directly in all Member States, prevailing over the provisions of Title IV of legge n. 218/1995. This means that judgments of divorce, personal separation or annulment of marriage pronounced in the EU are recognised automatically, without the need for further verifications by the civil status officer, save in exceptional cases.

However, the officer must ascertain that the judgment does not conflict with public policy or with other Italian judicial decisions.

For the purposes of registration, it is sufficient to present the certificate conforming to the European model, which contains all the essential information of the judgment, drafted in the language of the State of origin.

In cases in which doubts arise, such as default judgments or suspicions of violation of the rights of the parties, additional documentation may be requested to clarify any inconsistencies.

Registration of Non-EU Foreign Divorces: Specific Procedures

For divorce decrees issued in non-EU countries, the registration process in Italy is more complex. The civil status officer must verify that the foreign judgment complies with the fundamental principles of the Italian legal system, such as public policy and the parties’ rights of defense. Furthermore, a sworn Italian translation and legalization or an Apostille are always required.

For example, to register a foreign divorce decree through the Italian Consulate in Canada, the foreign judge must be deemed to have jurisdiction under the Italian legal framework, and the proceedings must meet the requirements of Article 64 of Italian Law No. 218/1995. The final decision to register the decree rests with the Civil Status Officer of the relevant Italian Municipality. Applicants must submit the divorce decree and the certificate of divorce, both legalized by Global Affairs Canada and translated into Italian, along with a statutory declaration of notary notoriety and a copy of a valid identity document.

To help you better understand what the registration of a foreign divorce entails, below is a standard template of an Italian municipal record for the registration of a divorce decree issued in Argentina:

Marriage Certificate – Part II, Series C

“Today (date)….. at (time), I, the undersigned …., Mayor and Civil Status Officer of the Municipality of Bologna, received a verbal request from Mr. ……, born in …. on …., residing in ….., to register the marriage dissolution decree issued on ….. by the Court of Buenos Aires (Argentina), of which he has provided a copy.Considering that the requirements provided by current legislation are met and that all due formalities have been respected, I hereby grant the request and proceed with the summary registration as follows:

(omissis)

WHEREFORE, the Civil Court of Buenos Aires (Argentina), by judgment No. ….., declares dissolved the marriage contracted in Buenos Aires (Argentina) on …. between …., born in Ancona on …., residing in Bologna, an Italian citizen, and …., born in …., residing in Buenos Aires (Argentina), an Argentine citizen, registered in the marriage records of this Municipality under No. … Part II, S.C of the year ….

Following this, I have countersigned and placed the copy of the registered document into the annexes volume of this registry.

This deed is read aloud to the attendees who, together with me, sign it. We provide comprehensive assistance, handling the meticulous verification of documents and all communications with the relevant authorities, to ensure that your divorce pronounced outside the European Union is legally recognized in Italy without disputes, thereby avoiding the judicial phase described above.

Costs and Timeframes for Registering a Foreign Divorce

The costs of registering a foreign divorce depend on the complexity of the case and the required documentation. A sworn translation generally costs a few hundred euros, while obtaining an Apostille or legalization typically involves a smaller expense.

Additional municipal or consular fees may apply.

Timeframes for registering a foreign divorce vary: EU divorces benefit from simplified procedures and usually take 1 to 2 months. For non-EU divorces, the process can take up to 6 months or longer, depending on whether additional verifications are required.

Boschetti Studio Legale guarantees transparent, fixed quotes provided from the very beginning with no surprises, accompanying you through every step to make the process as straightforward as possible.

Refusal of Foreign Divorce Registration: Grounds and Solutions

A request to register a foreign divorce can be rejected under several circumstances, particularly when the judgment does not comply with the requirements of the Italian legal system. The most common ground for refusal is a conflict with Italian public policy (ordine pubblico).

A public policy issue that frequently arises in practice involves Islamic divorces based on unilateral repudiation, known in Arabic as talaq. This is a method of dissolving a marriage that consists of the husband renouncing his wife. For the purpose of applying relevant private international law rules, Islamic repudiation is treated as a subcategory of divorce. Repudiation is thus assimilated to divorce based on the fact that both institutions aim to dissolve the marriage on a substantially voluntary basis—even though repudiation is often based on grounds that Italian law considers contrary to public policy.

Indeed, it must be noted that Islamic repudiation is generally contrary to public policy because it violates the principle of gender equality. However, the Italian Court of Cassation has recognized repudiation in specific scenarios where the wife had the opportunity to participate in the proceedings to defend her rights, and where she held an equal unilateral right to dissolve the marriage link without the husband’s consent. This is because not all Islamic legal systems regulate the institution of repudiation in the same manner.

Similarly, lower courts have issued rulings recognizing the effectiveness of repudiation in Italy, assessing compliance with the principles of the Italian legal order on a case-by-case basis. For instance, the Court of Appeal of Cagliari, in judgment No. 198 of May 16, 2008, declared effective a divorce decree issued by an Egyptian court based on talaq, ruling that it did not violate Italian public policy and that the wife had been given the opportunity to participate in the proceedings.

Another ground for refusing to register a foreign divorce may involve conflicts with other Italian or European judicial decisions. For example: a divorced couple of Italian citizens requests the registration of their foreign divorce in Italy. However, one of the spouses has already initiated separation or marriage annulment proceedings in Italy, and the Italian court has issued a decision that denies the validity of the divorce or imposes different conditions from those provided in the foreign judgment. In this scenario, registration of the foreign divorce could be denied because it would conflict with the ruling already issued by the Italian court.In the event of conflicting judgments—such as a foreign divorce that contradicts a prior Italian court order—Boschetti Studio Legale guides you to resolve any legal overlaps. Our expert team is fully equipped to file motions, lodge appeals, and handle any procedural suspensions, ensuring complete management of your legal needs at both national and international levels.

Furthermore, a denial of foreign divorce registration can stem from the lack of proper notice to the defaulting/non-appearing party (parte contumace). For example, an Italian citizen might discover they were divorced abroad without receiving timely notification of the proceedings. In these cases, it is crucial to verify that the trial respected the right to a fair defense. We can intervene to ensure that any irregularities are identified and that the recognition of the judgment is handled in strict compliance with your rights and international law standards.

Legal advice for civil unions

How can we help you?

When the procedure becomes complex, Boschetti Studio Legale, specialised in private international law and family law, can provide decisive assistance.

218 of 31 May 1995, "Reform of the Italian system of private international law", this process has been simplified because the recognition of foreign judgments and acts has become automatic (subject to the exceptions we are going to see).

Article 64, "Recognition of foreign judgments", in fact, provides that the foreign judgment is recognised in Italy, without the need to open any proceeding, when:

a) the judge who pronounced it could hear the case according to the principles on jurisdiction proper to the Italian legal system;

b) the introductory act of the proceeding was brought to the knowledge of the defendant in conformity with what is provided for by the law of the place where the proceeding took place and the essential rights of the defence were not violated;

c) the parties appeared in court according to the law of the place where the proceeding took place or contumacy was declared in conformity with such law;

d) it has become res judicata according to the law of the place in which it was pronounced;

e) it is not contrary to another judgment pronounced by an Italian judge that has become res judicata;

f) no proceeding is pending before an Italian judge for the same subject matter and between the same parties, which started before the foreign proceeding;

g) its provisions do not produce effects contrary to public policy.

In Brazil, for example, divorce, if it is consensual and there are no particular issues to be defined (e.g. on child custody), can be carried out by a notary (in the "Cartórios") without having to resort to the Court.

Relying on Boschetti Studio Legale, a Law Firm specialising in international law, is a strategic choice for those who must obtain the recognition of a foreign divorce judgment or of a foreign public deed of divorce in Italy.

However, the Italian Court of Cassation has recognized repudiation in specific scenarios where the wife had the opportunity to participate in the proceedings to defend her rights, and where she held an equal unilateral right to dissolve the marriage link without the husband's consent.

","margin_bottom":"default","margin_top":"default"}}]}],"props":{"layout":"1-4,3-4"}}]},{"type":"section","props":{"image_position":"center-center","padding_bottom":"small","padding_top":"small","style":"muted","title_breakpoint":"xl","title_position":"top-left","title_rotation":"left","vertical_align":"","width":"default"},"children":[{"type":"row","children":[{"type":"column","props":{"image_position":"center-center","position_sticky_breakpoint":"m"},"children":[{"type":"module","props":{"menu_image_align":"center","menu_image_margin":true,"menu_style":"default","menu_type":"nav","type":"builderwidget","widget":"builderwidget-64"}}]}]}],"name":"Casi Studio e Scenari tipici"},{"type":"section","props":{"image_position":"center-center","padding_bottom":"small","padding_top":"small","style":"primary","title_breakpoint":"xl","title_position":"top-left","title_rotation":"left","vertical_align":"","width":"default"},"children":[{"type":"row","children":[{"type":"column","props":{"image_position":"center-center","position_sticky_breakpoint":"m"},"children":[{"type":"panel","props":{"content":"

When the procedure becomes complex, Boschetti Studio Legale, specialised in private international law and family law, can provide decisive assistance.
